InstaPostGen provides a tool for creating Instagram post mockups without requiring a login or account. Our service is designed to be used in accordance with the following conditions:

• You may use our service for personal, educational, or commercial purposes.
• You may not use our service for any illegal purposes or to violate any laws in your jurisdiction.
• You may not use our service to impersonate others or to misrepresent your affiliation with any person or entity.
• You may not use our service to engage in any activity that could harm, disable, overburden, or impair our servers or networks.
• You may not attempt to gain unauthorized access to any part of our service, other accounts, or computer systems or networks connected to our service.

We reserve the right to terminate or restrict your use of our service, without prior notice, for any or no reason whatsoever.

Our service and its original content, features, and functionality are and will remain the exclusive property of InstaPostGen and its licensors. Our service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

The content you create using our service belongs to you. However, by using our service, you grant us a non-exclusive, royalty-free, worldwide license to use, store, and display your content for the purpose of providing and improving our service.

Please note that Instagram and its logo are trademarks of Meta Platforms, Inc. Our service is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. When using mockups created with our service, you should ensure that you do not violate Instagram's terms of service or intellectual property rights.

Our service allows you to create, upload, and share content. You are responsible for the content you create using our service and any consequences that may arise from your content.

You agree that you will not create or upload content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Infringes upon any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
• Constitutes unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation.
• Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity.

We reserve the right, but not the obligation, to monitor and review content created using our service and to remove any content that violates these Terms or that we find objectionable for any reason.

Your use of our service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

• The service will meet your requirements.
• The service will be uninterrupted, timely, secure, or error-free.
• The results that may be obtained from the use of the service will be accurate or reliable.
• The quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.
• Any errors in the service will be corrected.

In no event shall InstaPostGen, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from:

• Any errors, mistakes, or inaccuracies of content.
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our service.
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
• Any interruption or cessation of transmission to or from our service.
• Any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our service by any third party.
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the service.

The limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that InstaPostGen shall not be liable for user content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

You agree to defend, indemnify, and hold harmless InstaPostGen, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your content caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the service.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have between us regarding the service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
